1. The promoter is Millell Pty Ltd (trading as 'Pet Circle') (ABN 17 148 151 213) of Level 7, 9 Castlereagh Street, Sydney NSW 2000 (Pet Circle or the Promoter).

     
  2. By participating in this competition advertised by Pet Circle, entrants agree to be bound by these terms and conditions (Terms). Entries must comply with these Terms to be valid.

     
  3. The Competition starts at 9:30am Australian Eastern Daylight Time (AEDT) on 26/10/2024 and concludes at 11.59pm AEDT on 10/11/2024 (Competition Period).  

     
  4. Entries received by the Promoter after the end of the Competition Period will not be accepted. The time of entry will in each case be the time which the online entry is received by the Promoter's database, not the time of transmission by the entrant. The Promoter accepts no responsibility for any incorrect, incomplete, lost or late entries.

     
  5. Entry is open to Australian residents aged 18 years (Eligible Entrant).

     
  6. Employees and contractors (and their immediate families) of the Promoter or of any agency associated with the Competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

     
  7. To automatically enter the Competition, an Eligible Entrant must, during the Competition Period: 
    1. log in to their account at petcircle.com.au (Website); and
    2. use the single-use coupon code PCLOVER at checkout to make a purchase. 
       
  8. Only one (1) entry is permitted per Eligible Entrant during the Competition Period.

     
  9. The Promoter reserves the right to verify the validity of entries and to disqualify any individual who the Promoter believes has submitted an entry which is not in accordance with these Terms, has tampered with the entry process or has engaged in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of the Competition. 

     
  10. This competition is a game of chance. The draw will take place at Level 7, 9 Castlereagh Street, Sydney NSW 2000 at 11:00am AEST on Monday 11 November 2024 for Eligible Entrants received during the Competition Period (Draw Date). 

     
  11. The Promoter may draw additional reserve entries (Eligible Reserve Entry) and record them in order in case an invalid entry or ineligible entrant is drawn. 

     
  12. Winners will be notified by email and their names will be published online at www.petcircle.com.au/landing/dlf-keyring-comp on 12 November 2024 (Winner Announcement Date). 

     
  13. The Promoter's decision is final and no correspondence will be entered into in relation to such decision.

     
  14. The first thirty (30) valid entries randomly drawn on the Draw Date will win 1 x custom pet portrait keyring featuring one pet painted by Pop Art Puppy Dogs (the Artist) based on a picture or photo to be provided by the Winner and will be posted by the Artist at Pet Circle's cost to the Winner's preferred address in Australia by Standard Post. The total prize pool value is AUD $870.

     
  15. In order to claim a prize, a Winner must provide a picture or photo of their pet by 18/11/2024 (Prize Claim Date).  If for any reason, a winner does not claim their prize by the Prize Claim Date, the winner will no longer be entitled to the Prize and the Prize will be awarded to the next Eligible Reserve Entry.

     
  16. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

     
  17. If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.

     
  18. Any cost associated with accessing the Website is the entrant's responsibility and is dependent on the Internet service provider used. 

     
  19. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarentees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.

     
  20. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms; (e) any tax liability incurred by a winner or entrant; or (f) use / taking of the prize.

     
  21. All entries remain the property of the Promoter (including any intellectual property rights therein). Details from entries (including personal information (PI)) will be collected and used for the purposes of conducting the Competition (including verifying eligibility, awarding prizes, and any other related activities) and for promotional purposes surrounding the Competition or any products supplied by the Promoter (but not to the extent such activity is inconsistent with any opt-out from marketing or commercial electronic messages provided by the entrant). The Promoter will use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.petcircle.com.au/privacy. By entering the Competition, entrants consent to the use of their information and, if applicable, their photo, as described in these Terms. The Promoter will retain PI only for as long as necessary to fulfil the purposes of the Competition and related promotional activities. Entrants may request access to or correction of their PI by contacting the Promoter as outlined in its Privacy Policy.

     
  22. This Competition is in no way sponsored, endorsed, administered by or associated with Meta, Twitter, TikTok or YouTube. Any questions, comments or complaints about the Competition must be directed to the Promoter.  Neither Meta, Twitter, TikTok nor YouTube will be liable for any loss or damage or personal injury which is suffered or sustained by the entrant as a result of participating in the Competition, except for any liability which cannot be excluded by law.
